These Terms of Service ("Terms") govern your access to and use of the AllerG-Baby mobile application, website at allerg-baby.com, and related services (collectively, the "Service"), provided by Empowered Engineering LLC ("we," "us," or "our"). By creating an account, installing the App, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy.
If you do not agree to these Terms, do not use the Service.
2. Description of Service
AllerG-Baby is a personal allergy- and health-tracking tool that allows parents, guardians, and designated caregivers to log foods, reactions, environmental exposures, topical products, medications, and other information relevant to a child's health; to scan product barcodes for ingredient lookup; and to share access across multiple caregivers. The Service is intended as an organizational and informational aid only.
3. Eligibility & Accounts
You must be at least 18 years old and legally able to enter into a binding contract to create an account. You must be the parent or legal guardian of any child whose information you record, or have express authorization from that child's parent or legal guardian.
You are responsible for:
- Providing accurate, current information when creating your account.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us promptly if you suspect unauthorized access.
4. Medical Disclaimer
AllerG-Baby is not a medical device and does not provide medical advice, diagnosis, or treatment. Information provided in the Service, including ingredient data, allergen flags, and reaction history, is for informational and organizational purposes only. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition, allergy, or treatment.
In a medical emergency, call your local emergency number immediately. Do not rely on the Service to provide urgent or time-critical medical guidance.
Ingredient and product information is retrieved from third-party databases (including Open Food Facts, Open Beauty Facts, and Open Products Facts) and may be incomplete, outdated, or inaccurate. You are responsible for verifying ingredients, allergens, and product safety with manufacturers, healthcare providers, and product labels before use.
5. User Responsibilities
By using the Service, you agree that you will:
- Use the Service only for lawful purposes and in accordance with these Terms.
- Verify information before acting on it, particularly in health-related decisions.
- Only share caregiver access with individuals you authorize and trust.
- Keep your account and device secure.
- Respect the privacy of all individuals whose information you record.
6. User Content
You retain ownership of all content you record in the Service, including log entries, profile data, and health information ("User Content"). By using the Service, you grant Empowered Engineering LLC a limited license to store, process, and display your User Content solely to provide the Service to you and any caregivers you authorize.
We do not sell your User Content, use it for advertising, or share it with third parties except as described in our Privacy Policy.
7. Subscriptions & Billing
Certain features of the Service may be offered on a subscription basis through the Apple App Store or Google Play Store. If you purchase a subscription:
- Billing, renewals, and cancellations are handled by the applicable app store, not by us.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, per app store policy.
- Refunds are governed by the app store's refund policy.
- Prices and features may change; we will notify you of material changes before they take effect.
Beta access is offered free of charge during our beta period. We may change, limit, or discontinue beta features at any time without notice.
8. Prohibited Uses
You may not, and may not permit others to:
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service to infringe on the privacy or rights of any individual.
- Upload malicious code, attempt to gain unauthorized access, or disrupt the Service.
- Use the Service in any manner that violates applicable law or regulation.
- Resell, sublicense, or commercially exploit the Service without our written consent.
- Use automated systems to access or scrape the Service.
- Represent the Service as providing medical advice, diagnosis, or treatment to others.
9. Third-Party Services
The Service integrates with third-party services, including Supabase (authentication and backend), the Apple App Store and Google Play Store (distribution and billing), and public product databases (Open Food Facts, Open Beauty Facts, Open Products Facts). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.
10. Intellectual Property
The Service, including its design, code, branding, text, graphics, logos, and the "AllerG-Baby" name, are owned by Empowered Engineering LLC or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use in accordance with these Terms.

11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." To the maximum extent permitted by law, Empowered Engineering LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses, or that ingredient or allergen data will be accurate or complete.
12. Limitation of Liability
To the maximum extent permitted by law, in no event shall Empowered Engineering LLC, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory.
Our total aggregate liability to you for any and all claims arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
13. Indemnification
You agree to indemnify and hold harmless Empowered Engineering LLC and its officers, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your misuse of the Service, (c) your User Content, or (d) your violation of any rights of another person or entity.
14. Termination
You may stop using the Service and delete your account at any time through the App's settings or by contacting us.
We may suspend or terminate your access to the Service, in whole or in part, at our discretion if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. Upon termination, sections that by their nature should survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Rhode Island, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Rhode Island, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Effective Date" above and notify you within the App, by email, or on the website. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
